The terms outlined herein govern your usage of the website (referred to as the “Service”) managed by Sizar Medicine LLC operating under the name Sizar Wellness and its affiliated entities (referred to as “we” or “us”). Your access to this Service or engagement with our media platforms constitutes acceptance of these Terms of Use and our Privacy Policy. Failure to agree to these Terms of Use prohibits your use of this Service and engagement with our media platforms.

Permitted Use:

You are permitted to access and utilize this Service only if you are 18 years of age or older, and solely for your personal, non-commercial purposes. Your usage must comply with all relevant laws of the state of Maryland. You understand that you do not gain any ownership rights to the website or its content. Prohibited activities include unlawful use and any actions that could harm or disrupt the website, or interfere with others’ use of the site and its content. Unauthorized access attempts, including hacking or password mining, are strictly prohibited. You may not obtain materials or information through any unauthorized means not intentionally provided by the website.

Member Portal Account:

By creating an account with us, you affirm that you are over the age of 18 and that the information you furnish is accurate, complete, and up-to-date at all times. Providing inaccurate, incomplete, or outdated information may lead to immediate termination of your account on the Service. You are responsible for safeguarding the confidentiality of your account and password, including but not limited to restricting access to your computer and/or account. You agree to bear responsibility for all activities or actions occurring under your account and/or password, whether the password is associated with our Service or a third-party service. Promptly inform us of any security breaches or unauthorized use of your account. Using another person’s or entity’s name as your username, or a name or trademark that is not lawfully available for your use without proper authorization, is prohibited. Additionally, usernames that are offensive, vulgar, or obscene are not permitted. We retain the right to decline service, terminate accounts, edit or remove content, or cancel orders at our sole discretion.

Payment terms:

Some functionalities of the Service may necessitate payment of fees. Prior to any payment, you will be given the chance to review and agree to the fees applicable to you. Unless expressly stated otherwise in these Terms, all fees are denoted in U.S. Dollars and are non-refundable, except as mandated by law.

1. Pricing: Sizar Medicine LLC retains the authority to establish pricing for the Service. We will strive to ensure that pricing information displayed on the Service remains current. We reserve the right to modify fees for any Service feature, including additional fees or charges. Sizar Medicine LLC, at its discretion, may offer promotional deals with varying features and pricing to Index Health’s customers. Unless specifically offered to you, these promotional offers will not apply to your agreement or these Terms.

2. Authorization: By agreeing to these Terms, you grant Sizar Medicine LLC permission to charge all sums for your orders and any chosen level of Service, as outlined in these Terms or as published by Sizar Medicine LLC, including applicable taxes, to the payment method specified in your account. If you pay fees using a credit card, Sizar Medicine LLC may seek pre-authorization from your credit card account before your purchase to confirm the card’s validity and ensure sufficient funds or credit are available.

3. Subscription Service: The Service may include certain subscription-based plans with automatically recurring payments for periodic charges (“Subscription Service”). Upon payment of the $499 membership onboarding fee, you will select the most suitable Subscription service model for you. The “Subscription Billing Date” marks the date of your initial subscription purchase after the Initial Onboarding visit. The Subscription Service begins on the Subscription Billing Date and continues for the subscription period you choose on your account (referred to as the “Initial Subscription Period”). It will automatically renew for successive periods of the same duration as the Initial Subscription Period (each such renewal period, a “Subscription Period”) unless you cancel the Subscription Service or it is terminated by us. By activating a Subscription Service, you authorize Index Health or its third-party payment processors to periodically charge, until cancellation of the Subscription Service, all accrued sums on or before the payment due date. Your account will be automatically charged on the Subscription Billing Date and subsequently on the renewal date of your Subscription Service for all applicable fees and taxes for the next Subscription Period. To avoid being billed the next periodic Subscription Fee, you must cancel your Subscription Service at least 30 days before it renews, with the cancellation period only applicable after the minimum commitment period, which is 5 months for the Longevity Executive subscription and 3 months for the Longevity Elite and Essential subscription. Index Health or its third-party payment processor will bill the periodic Subscription Fee to the payment method associated with your account or as otherwise provided by you. You can cancel the Subscription Service by emailing us at info@sizarwellness.com.

Indemnification:

You consent to defend, indemnify, and exempt Sizar Medicine, LLC, its licensee, licensors, employees, contractors, agents, officers, and directors from any and all claims, damages, obligations, losses, liabilities, costs, or debts, including but not limited to attorney’s fees, arising from: a) your access to and utilization of the Service, whether by you or any individual using your account and password, or b) any violation of these Terms.

Our Service may feature links to third-party websites or services that are not owned or operated by Sizar Medicine LLC. We do not exercise control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not endorse the offerings of these entities or individuals or their websites.
